Introduction & Intent​

 

Sunset Pastures is Montrose County’s first Agrihood—a neighborhood rooted in nature, built around a working farm, and designed to encourage outdoor living, connection, and stewardship of the land. Gerken’s Organics, LLC, the founding developer, has carefully curated these covenants to protect the land’s agricultural legacy while fostering a vibrant, low-density community lifestyle.​

 

Disclaimer for Lot TBD Racine Rd:

 

Gerken’s Organics wishes to be fully transparent: We intend to develop additional lots surrounding Lot TBD Racine Rd as part of our broader vision for Sunset Pastures. This evolving agrihood will likely include community trails, gardens, composting, a pond, shared fire pits, a children’s park, shared BLM access, and open space. HOA participation for Lot TBD Racine Rd will be optional, but the covenants herein are binding and perpetual. Owners of Lot TBD Racine Rd will be invited to opt into full HOA membership and Sunset Pastures community amenities but are only required to comply with the restrictions in this covenant document unless they choose to join the HOA at which time their obligations will transfer to those of the HOA at Sunset Pastures. ​

 

1. Building Setbacks​

 

  • All structures (homes, ADUs, outbuildings, etc.) must be built within 10 feet of the outer most property line, unless written approval is granted by Gerken’s Organics.

  • Structures must fall within Montrose County setback requirements and be positioned according to the natural contours of the land; while a 10’ setback is the general goal, flexibility is allowed where appropriate (e.g., northern lots may have reduced setbacks to allow small backyards and because they do not obstruct views), with an emphasis on maintaining larger open front areas to enhance the sense of space between homes.

 

This preserves centralized open space and shared views.​

 

2. Subdivision Prohibition​

 

  • No lot, may be further subdivided.

 

This ensures long-term preservation of the land’s rural character.​

 

3. Permitted Structures​Each lot is permitted the following structures:

 

  • One (1) Primary Residence

  • One (1) Accessory Dwelling Unit (ADU) Max 800 sq ft and single story

  • One (1) Agricultural Outbuilding or Garage / Shop

All buildings must be stick-built on-site. Manufactured homes, mobile homes, modular buildings, pre-fabricated structures, or shipping container constructions are not permitted for any of the approved building types listed above. This is to maintain design continuity, community aesthetics, and long-term structural integrity within Sunset Pastures.

​​4. Animal Housing ​

 

One (1) animal shelter is permitted per lot.

 

This structure must:

 

  • Be no more than 12 feet tall and 800 sqft

  • Be located in area that does not obstruct the view of other lots

  • Be maintained in a sanitary and humane manner

  • Not cause excessive odor, runoff, or noise impacting neighboring lots.

 

5. Agricultural Animal Allowance​

 

Lot owners may keep:

 

  • Up to 12 poultry (chickens, ducks, etc.)

  • Up to 4 small livestock (goats, sheep, etc.)

  • Up to 2 large livestock (cows, pigs, horses, etc.) per farmable acre​

 

All animals must be humanely kept and in enclosures that align with the community’s rural aesthetic.

 

​6. View and Landscape Preservation​

 

  • All lots will be fenced in with approved farm fencing as part of the initial build.

  • Privacy fences are strictly prohibited, including solid fencing or any landscaping designed to obstruct the visibility of adjacent properties.

  • Any trees, shrubs, or landscaping planted within designated scenic view corridors must be approved in writing by the HOA (Temporarily Gerken’s Organics) to preserve views of the surrounding landscape, including sunsets and mountain vistas.

  • Properties must be maintained in an aesthetically pleasing manner.​

 

7. Builder Designation ​​​​​

 

  • Bradburn Family Enterprises is the mandated builder for these lots

  • All construction must be approved by the Architectural Committee and within Bradburn Family Enterprises building guidelines.  

 

This mandate helps preserve design continuity and supports community development initiatives.​

 

8. Feel Good About Joining the Agrihood! ​

 

1% of each build will be donated to Outer Range, Montrose’s first outdoor education school.​​

 

Enforcement & Amendments​

 

These Covenants shall be enforceable by Gerken’s Organics, LLC and may be assigned to the Sunset Pastures HOA upon full Agrihood formation.Covenants may be amended by a â…” vote of the HOA, except: Sections 2, 3, 7, and 8, which are irrevocable.​​

Homeowners Association (HOA) Formation and Participation

 

Upon completion and full development of the community known as Sunset Pastures, a Homeowners Association (the "HOA") shall be formally established to preserve and manage the shared assets and responsibilities of the community.

 

The initial HOA dues shall be one hundred dollars ($100.00) per month, per Lot, which amount is subject to modification by the HOA upon its official formation and in accordance with its bylaws and governing documents.

 

The purpose of the HOA shall include, but not be limited to, the maintenance, improvement, and preservation of shared community spaces and amenities, including:

​

  • Access to adjoining Bureau of Land Management (BLM) lands

​

  • The pond and adjacent recreational spaces

​

  • Community gardens

​

  • The children’s park

​

  • Internal trails and walking paths

​

  • Roadways and related infrastructure within SunsetPastures

​

Special Provision for 68591 Racine Rd. & Gerken's Organics Farm:

​

These lots shall be permanently exempt from all HOA rules and regulations, including architectural and land use restrictions imposed by the HOA. However, these lots shall remain obligated to pay the monthly HOA dues in full, ensuring equitable financial contribution for the continued access to and benefit from shared community spaces.

 

HOA fees shall be reasonable, fair, and equally applied to all Lots, including special provisioned lots, and may only be increased or modified through a process defined in the HOA’s governing documents with appropriate notice and participation from the membership.
